TELECOMMUNICATIONS

The telecommunications industry is at the forefront of the information age delivering traditional data at speeds previously unheard of and in an increasing number of ways. No other industry touches every technology-related business sector.

Recognizing this, our attorneys have consistently and successfully represented telecommunications companies and Internet Service Providers (ISPs) in many different capacities, including the negotiation and preparation of Service Level Agreements (SLAs), purchase and sales agreements and wholesale and retail agreements. Our practice also includes representing municipalities in renewal negotiations under federal law involving cable television franchises and advocacy for Public, Educational and Governmental (PEG) interests in those negotiations.

A member of the Telecommunications Practice Group served as Trustee in the bankruptcy of Telergy, Inc. and operated the Telergy fiber-optic network throughout the State of New York. We acted as counsel to the Trustee in preserving and selling the operating network in New York without loss of services to businesses, hospitals, educational institutions, and the New York State governmental intranet. In this process, we preserved and resolved issues relating to Indefeasible Rights of Use (IRUs), and negotiated and settled complex disputes with Tier 1 Providers, easement holders, utility companies, municipalities, and financial institutions.

Our attorneys participated in the noted Adelphia Communications bankruptcy case with respect to the proposed transfer of its cable television franchises.

We currently represent a not-for-profit corporation which provides an optical research and educational network to colleges, universities and other institutions throughout the State of New York and provides a variety of services such as building and network access, vendor and member contracts, interconnection agreements, and colo agreements.

We represented Steleus, Inc., a real-time performance management company that supplied network-related intelligence to telecommunications operators.  Our representation included all aspects of Steleus’ international business operations, and its sale to and absorption by Tekelec, a public company, for $59 million in October, 2004.

Additionally, we have represented the owners or builders of cell phone towers in contracting for suitable tower space and negotiated municipal and zoning approval for the towers.
